The Cheka-OGPU has at its disposal the full text of the order of the First Deputy Minister of the Ministry of Internal Affairs Gorovoy on the use by the police of Article 20.3.3 of the Code of Administrative Offenses (discrediting the armed forces of the Russian Federation). According to the deputy minister, since the entry into force of this norm (from March 4, 2022), police officers have drawn up 3,303 protocols in the case of an administrative offense of this category; based on the results of their consideration, 1,547 (51.6%) decisions on assigning punishment.

The court returned 38 materials from cases of administrative offenses for revision. Proceedings in 90 cases were discontinued, of which 60 (66.7) were due to the absence of an offense, 5 were due to the absence of an offense, and 13 were due to the expiration of the statute of limitations for administrative liability.

Gorovoy is extremely dissatisfied with the poor performance under this article of the Administrative Code. “These circumstances were the result of ignorance by authorized officials of internal affairs bodies of the norms of the Code of Administrative Offenses, improper interaction of police services and units in the course of identifying and documenting offenses, and lack of control on the part of managers over the quality and timing of preparation of materials on cases of administrative offenses.

He further proposes a number of measures to improve indicators, explaining them by the need to “ensure the rule of law, the rights and freedoms of citizens.”
